These terms cover use of atomhome.ai and the Atom platform. Atom is currently in staging and available to invited pilot operators only, so several of these terms describe how things will work at general availability.

1. The agreement

By creating an Atom account or using the Atom Home app you agree to these terms. If you are agreeing on behalf of a business, you confirm you can bind that business.

2. Accounts and roles

Operators hold the primary account and control who else has access: office staff, technicians, and the households they serve. Operators are responsible for the accuracy of the data they enter and for the conduct of users they invite.

Atom Home accounts are free to households served by an Atom operator and are tied to that service relationship. If the relationship ends, historical records may stop being visible in the app.

3. Pricing and billing

Atom costs $9.95 per month per operator account, plus 1% of all volume invoiced through the platform in that calendar month, from the first dollar. For the first 60 days after account creation the $9.95 subscription is waived; the 1% applies throughout, including during those 60 days. There is no cap and no per-seat charge — seats are unlimited. Homeowner seats are unlimited and free.

Support, including escalation to a person, is available to every account on the same terms.

The subscription is billed monthly; the 1% is calculated and billed monthly in arrears, once that month’s invoiced volume is known. Taxes are additional where applicable.

4. Your data

You own your operational data. We hold a licence to process it only to provide and improve the service, as described in the privacy note.

Full export is available on demand, including before access ends on termination.

5. Acceptable use

Do not use Atom to break the law, to store data you have no right to hold, to reverse engineer the service, or to resell access without a written agreement.

We may suspend an account for non-payment or for conduct that puts other customers or their data at risk. We will tell you why.

6. Availability during staging

While Atom is in staging and pilot, the service is provided as-is. Features will change and data may be migrated between environments with notice. Do not rely on staging as your system of record for a compliance obligation until we tell you it is generally available.

7. Liability

To the extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months before the claim, and we are not liable for indirect or consequential loss.

Nothing here limits liability that cannot be limited by law.

8. Ending the agreement

You can close your account at any time. We can end the agreement with 30 days’ notice, or immediately for the reasons in the acceptable-use section. Fees paid for the current period are refunded pro rata if we end it without cause.

9. Governing law

These terms are governed by the laws of the jurisdiction in which Atom Data Solutions LLC is organised. Insert the jurisdiction and dispute-resolution mechanism before launch.
